A property tax grievance is a formal challenge to your property’s tax assessment. If your home or commercial building is over-assessed, you may be paying more in property taxes than you should. Who can file a property tax grievance?
Generally, owners of both residential and commercial properties are eligible to file a grievance. Tenants who are obligated to pay real estate taxes may be entitled to file as well.
When is the deadline to file a tax grievance?
Filing deadlines vary by jurisdiction. For example, Nassau County typically accepts grievances beginning in January, the Suffolk County towns' deadline is in May, and the deadlines in Westchester vary considerably by municipality. Can I still file a tax grievance if I receive S.T.A.R.?
Yes. The School Tax Assessment Relief Credit (STAR) and property tax grievance are two completely separate programs. STAR provides school tax relief based on income and residency, while a grievance challenges your property’s assessed value. Many homeowners benefit from both.
Is there any risk in filing a grievance?
No. Your assessment cannot be increased because you filed a grievance. The worst-case scenario is that your taxes remain the same.
Will filing a grievance affect the resale value of my home or building?
No. Filing a grievance does not negatively impact your property’s resale value. In fact, having a lower tax bill may make your property more attractive to future buyers.
Do I need an attorney to file a tax grievance?
While homeowners can file on their own, hiring an experienced attorney may improve the likelihood of success. For commercial property grievances, professional representation is strongly recommended, and often times required.
Do I need to attend a hearing for my tax grievance?
